Welcome to Épanoui Travel, operated by My Epanoui Limited ("Epanoui", "we", "us", or "our"), a company registered in England and Wales. These Terms of Service ("Terms") govern your use of www.epanouitravel.com (the "Platform") and the booking services provided therein.
By accessing our Platform or making a booking, you agree to be bound by these Terms. If you do not agree, you must cease using the Platform immediately.
2.1 Intermediary Status: Epanoui acts solely as a disclosed commercial agent for third-party travel providers, hosts, and tour operators ("Providers").
2.2 The Contract: When you book a "Stay," "Play," or "Stay & Play" experience, the contract for the service is created directly between You (the "Traveller") and the Provider. Epanoui is not a party to that contractual relationship.
2.3 No Liability for Performance: We are responsible for the correct operation of the Platform and the secure processing of payments. We are not responsible for the acts, omissions, safety standards, or service delivery of the Providers.
3.1 Inventory Source: Our bookings are facilitated through the Bokun marketplace and other integration partners.
3.2 Supplemental Terms: Your booking is subject to the specific Terms and Conditions of the Provider (e.g., cancellation windows, health & safety rules, waivers). These specific terms are presented to you at the time of booking. By completing a transaction, you acknowledge and accept the Provider's terms in addition to this Agreement.
3.3 Accuracy: While we strive to ensure listing descriptions are accurate, all content (images, amenities, itineraries) is provided by the Provider or via API. Epanoui does not verify and is not liable for inaccuracies in Provider-generated content.
4.1 Merchant of Record: Epanoui acts as the Merchant of Record for all transactions. We are authorised by the Provider to accept payment on their behalf.
4.2 Discharge of Debt: Payment of the booking amount to Epanoui constitutes final settlement of your obligation to the Provider. The Provider has no right to demand payment from you directly if you have successfully paid Epanoui.
4.3 Processing: All payments are processed securely via Stripe. We do not store full credit card details.
4.4 Currency: Charges are processed in the currency displayed at checkout. Your bank may charge additional foreign exchange fees if your card currency differs.
5.1 Provider Policy Rules: Cancellation rights are governed strictly by the specific policy attached to your booked experience (e.g., "Strict," "Moderate," or "Flexible") as defined by the Provider.
5.2 Refund Process: If you are entitled to a refund under the Provider's policy, Epanoui will process this refund to your original payment method via Stripe. Refund processing times typically range from 5–10 business days.
5.3 Total Price Refunds: Refunds are calculated on the total price paid at checkout. We do not charge a separate processing fee for cancellations unless the Provider's policy explicitly includes penalties.
You agree to:
7.1 General Disclaimer: To the fullest extent permitted by English law, Epanoui excludes all liability for any loss, damage, personal injury, or death arising from the services provided by the Provider.
7.2 Force Majeure: We are not liable for any failure to perform our obligations where such failure results from any cause beyond our reasonable control, including but not limited to acts of God, war, riot, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, or strikes.
7.3 Cap on Liability: In any event, our total liability to you for all claims arising out of or relating to these Terms or your use of the Platform is limited to the total amount of booking fees paid by you to Epanoui in the 12 months prior to the claim.
You agree to indemnify and hold harmless My Epanoui Limited, its officers, directors, and employees from any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of your violation of these Terms, your violation of any Provider's terms, or your violation of any law or third-party right.
These Terms are governed by the laws of England and Wales. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
